The 29-year-old actor was charged Thursday with third-degree felony aggravated assault, which is punishable by up to five years in prison. He was also faces a misdemeanor charge of intoxication.

The incident occurred while Hirsch was in town for the Sundance Film Festival. On Jan. 25, court documents state, Hirsch approached a female Paramount executive and asked her why she looked “so tough,” and said she was a “rich kid” who should not be at Sundance.

The woman pushed Hirsch away, after which he allegedly put her in a chokehold and pulled her across a table and onto the floor. He then allegedly wrapped his hands around her neck.

The woman recalled to police that she may have blacked out momentarily.

In his conversation with police, Hirsch said he had a “verbal confrontation” with the woman, whom he said he did not know, and that he’d had three or four alcoholic drinks. A police officer reportedly detected an odor of alcohol from Hirsch’s mouth, and said his balance was poor and the actor slurring was some of his words, according to documents.

Hirsch is due in court on March 16.

Hirsch attended Sundance to promote a movie titled Ten Thousand Saints, also starring Asa Butterfield and Ethan Hawke. His other credits include Into the Wild, The Girl Next Door, Lone Survivor and Milk.
